  1. General information 

    In order to offer you the best services, we process personal data about you.

    We guarantee that your personal data is processed in compliance with the applicable data protection legislation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data) and are under the responsibility of:

  2. Basis for processing

    Personal data as described in point 4 hereof shall be processed on the basis of Article 6(a ), (b), (c) and (f), Article 49(1). a) the General Data Protection Regulation, namely:

    • Consent for one or more specific purposes;
    • The performance of a contract to which the data subject is a party;
    • Compliance with the legal obligations to which the controller is subject, in particular in tax and social matters;
    • The legitimate interest of the controller in the context of the proper management of his company;

  3. Purposes of the processing

    The personal data we collect is only processed for the following purposes:

    •  Realization of the corporate purpose of SRL QubeS.;
    • Compliance with the obligations incumbent on SRL QubeS in regard to the Belgian authorities, foreign authorities in application of the legal and regulatory provisions incumbent on it or a decision of a judicial authority;
    • Management of relationships with clients, consultants, subcontractors and other third parties;
    • Safeguarding the legitimate interest of SRL QubeS.  and its members in the context of its proper management  ;
  4. Categories of data

    We collect data that you agree to provide to us. This is essentially the following data:

    • Identification data: Surname, first name, date of birth, place of birth, national number, e-mail address, bank account, curriculum vitae etc.
    • Related data

    The aforementioned personal data may be collected by QubeS.  to the Customer himself, public databases or private databases.

    When data is communicated by the Customer or at his request, the latter guarantees that this communication takes place with the agreement of the persons concerned and in accordance with the applicable legislation. The Customer guarantees QubeS.  against any claim of the persons concerned.

    The data is only processed if such processing is necessary for the purposes mentioned in point 3.

    Personal data are not transmitted to countries outside the European Union unless the purposes referred to in point 3 justify it and the person has previously agreed to such a transfer.

  5. Subcontractors and sub-processors

    Unless it is necessary to communicate personal data to organizations or entities whose intervention as third party service providers on behalf of and under the control of the controller is required for the aforementioned purposes, we will not transmit the personal data collected in this context, unless you have been informed of this  beforehand and that you have explicitly given your consent.

    The sub-contractors we use in connection with the processing of your personal data are listed in a register of processing activities that is kept internally.

    We provide our subcontractors with only the personal information they need to perform the services we entrust to them, and we require that they protect this information and not use it for any other purpose.

    In any case, we ensure that our subcontractors comply with the same level of requirements regarding the protection of personal data.

  6. Shelf life

    The retention periods depend on the purposes for which the data were collected and processed.

     Personal data are only kept for the periods provided for by the implementing legislation, such as accounting legislation and tax legislation (7 years from the end of the mission carried out by SRL QubeS.  for the benefit of the customer concerned).

    Once the aforementioned periods have expired, the personal data will be deleted, unless other legislation in force provides for a longer retention period.

    The data may be kept longer if this is necessary to guarantee the legitimate interest of the controller in the context of the proper management of the company.

     At any time, you can ask us to erase your personal data.

  7. Who is responsible for the protection of your data?

    1410 Waterloo , Belgium is responsible for your data as the “data controller”.

    QUBES. SRL also act as “data processors” on behalf of their clients when processing data in the context of biostatistical services.

  8. Updating data

    We undertake to erase or rectify any data that proves to be inaccurate.

  9. Data storage, security and confidentiality

    The method of storage of personal data as well as the security and confidentiality measures thereof are listed in documents that we keep internally and that are reviewed and updated at least once a year.

    We guarantee that technical, organizational and human measures are taken to ensure the security and protection of the confidentiality of your personal data.

    In the event of a breach of your personal data, we undertake, in accordance with the applicable legislation, to notify the Data Protection Authority as soon as possible and, if possible, no later than 72 hours after becoming aware of it.

  10. Your rights and methods of exercise

    At any time and free of charge, you have the possibility: 

    • access and retrieve your data in copy form (easily usable and allowing data portability);
    • to request the erasure of your data;
    • to modify your inaccurate or incomplete data;    to request a limited use of your data
    • to object to your data being processed.

    Your request will be processed as soon as possible and in any case within one month of receipt of your request.
